THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.12048 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2, 3 & 4 seeking bail in the event of their arrest in connection with Crime No.888 of 2021 on the file of Neredmet Police Station, Rachakonda Commissionarate, registered for the offences under Sections 306 and 498-A r/w. 34 of IPC.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the deceased is the wife of A-1. She was married to A-1 on 27.06.2021. For nearly one year, they lived happily. However, A-1 started harassing her physically and mentally on small issues. Further, these petitioners who are mother-in-law and brotherin-laws were quarreling with the deceased. Two years prior to death, A-1 quarreled with the deceased and beat her for which reason, she stayed at her parents house. Steps were being

taken to hold a panchayat. However, the deceased committed suicide.

Learned counsel for the petitioners would submit that both A-1 and the deceased were staying in the house of the de-facto complainant since two months, as such, the question of these petitioners harassing the deceased does not arise. 5.

On the other hand, learned Additional Public Prosecutor opposed the bail application.

As seen from the complaint, bald allegation is made that these petitioners were quarreling with the deceased. Except the said allegation, nothing specifically is attributed to these petitioners. Further, since the alleged suicide took place after she left to her maternal house and staying with her parents, the prayer for anticipatory bail can be considered, subject to following conditions:-

1) The petitioners/Accused Nos.2, 3 & 4 is directed to surrender before the Station House Officer, Neredmet Police Station, Rachakonda Commissionarate, Medhcal-Malkjgiri District, on or before 18.12.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.2, 3 & 4 on bail, on their executing personal bond for a sum of Rs.25,000/-

(Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.3 and 4 shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of four weeks for the purpose of investigation and thereafter, as and when required. As far as petitioner/Accused No.2 is concerned, she shall appear as and when required.

3) The petitioners/accused Nos.2, 3 and 4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 7.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
