HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29440 of 2018 ORDER:
The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the 3rd respondent is considering the request of the 4th respondent to mutate his name in the ROR in respect of the land in Survey Nos. 368, 369, 376, 377, 378, 379, 382, 393, 394, 404, 91 and 92, admeasuring Ac.14-01 guntas at Upparapally village of Ghanapur Mandal, and also the land in Survey Nos. 105 and 106, admeasuring Ac.5-24 guntas at Surayapalli village of Ghanapur Mandal, Wanaparthy District, and proposing to issue new Pattadar Pass book in his favour under Rythu Bandhu scheme by not considering the objections dated 03.05.2018 submitted by the petitioner, though the suit for partition in O.S.No. 61 of 2015 is pending among all the legal heirs of Late Gal Reddy, including the petitioner and the 4th respondent, as illegal, arbitrary and unconstitutional. 2.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner would submit that pursuant to the application made by the 4th respondent on 03.05.2018 seeking mutation, the petitioner filed his objections disputing the same, and hence, seeks a direction
to the concerned to take his objections into consideration and hear him before acting on the application for mutation. 3.
Having regard to the above, the present writ petition is disposed of with consent, at the admission stage, directing the concerned authority to take into consideration the objections filed by the petitioner, give personal hearing to all concerned and then pass appropriate orders on the application filed by the 4th respondent on 03.05.2018 seeking mutation, in accordance with law. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
