THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.38372 of 2016 ORDER:

Heard Sri V.Venkata Mayur for petitioner and Sri N.Vasudeva Reddy for respondents.

The complaint of petitioner is against encroachment of land in an extent of Ac.0-181⁄2 gts., in Sy.No.697 of Kulkacherla Village and Mandal, Ranga Reddy District.

I have perused the averments in the writ affidavit and the documents on which the petitioner is relying upon. This Court is of the view that the prayer under Article 226, having regard to nature of controversy, is not an appropriate remedy and the petitioner has to work out all the grievances against respondents in a properly instituted suit or proceeding. On the ground that the writ is not maintainable for the prayer has to be properly worked out in an instituted suit, the writ petition is dismissed by granting liberty to work out remedies. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
