THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21038 of 2005 ORDER:

This writ petition is filed seeking the following relief: " To issue a Writ, Order or directions, more in the nature of Writ of Mandamus directing the respondent herein to grant Special Grade increment immediately after completion of 12 years service from the date of initial appointment including by counting continuity of service granted by Hon'ble High Court in Writ Petition No.16927 of 1994 dated 16.1.96 with all consequential benefits including benefit of pay fixation and arrears and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

When the matter is taken up for hearing, it is noticed that the petitioner is seeking stagnation increment from the year 2000 on completion of 12 years of active service.

The respondent corporation filed counter affidavit contending that the petitioner is entitled for grant of stagnation increment from 1.8.2005.
