HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27387 OF 2016 ORDER:

The case of the petitioners is that the documents presented by them for registration have been refused by the 3rd respondents on the ground that said documents are not supported by any Pattadar Pass Books and Title deeds. Aggrieved by the same, present writ petition is filed. Learned counsel for the petitioners submits that in view of the Circular Memo No.G1/1249/2012, dated 25.06.2016, the registering authority shall not insist on production of Title Deed cum Pass Book and the registration can be effected on the basis of entries made in the Record of Rights maintained electronically.

Heard learned Assistant Government Pleader for Revenue.

The amendment made to Section 6(D) of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') reads as follows;

"6-D. Registering authority to effect registration based on electronically maintained Record of Rights: The Registering authority appointed under the Registration Act, 1908, shall effect the registrations on the basis of entries made in the Record of Rights maintained electronically and shall not insist on production of title deed cum pass book."

In view of the above amendment made to Section 6-D of the Act, the order of refusal is set aside to the extent of the ground based on which the 3rd respondent refused to approve the documents as it is not supported by pattadar pass books and title deeds and the 3rd respondent is directed to consider the documents presented by the petitioners for registration in terms of the amended provision under Section 6-D of the Act, provided the documents are in order as per the provisions of Stamps and Registration Act and the Rules made thereunder. Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.09.2016 t k
