THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.14308 OF 2016 ORDER:

It is submitted by the learned counsel for the petitioner that the issue involved in this writ petition is squarely covered by the decision of this Court in W.P.No.39888 of 2015 dated 09.12.2015 and that a large number of similar and identical cases have been disposed of directing the authorities to release the seized vehicles in terms of G.O.Ms.No.3, Industries and Commerce (Mines.I) Department, dated 08.01.2015 as amended by G.O.Ms.No.15, Industries & Commerce (Mines.I) Department, 19.02.2015.

The aforesaid submission made by the learned counsel for the petitioner is admitted by the learned Government Pleader for Mines and Geology appearing for the respondents. Further, the learned Government Pleader submits that this writ petition may be disposed of in similar lines to the order of this Court dated 09.12.2015 passed in W.P.No.39888 of 2015. In view of the above, this writ petition is disposed of following the decision of this Court in W.P.No.39888 of 2015 dated 09.12.2015 directing the 2nd respondent to consider for release of the seized vehicle. Since the petitioner has already submitted his application to the said respondent, he is directed to consider the same and pass appropriate orders as per G.O.Ms.No.3, Industries and Commerce (Mines.I) Department, dated 08.01.2015 as amended by G.O.Ms.No.

15, Industries & Commerce (Mines.I) Department, dated 19.02.2015 for release of the seized vehicle within a period of three days from the date of receipt of a copy of this order. Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. There shall be no order as to costs.
