Aggrieved by the action of 2nd respondent in not registering the crime based on the complaint of the petitioner dated 17.07.2018 against 3rd respondent, and conducting investigation, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police Shamshabad Police Station, stating that based on the complaint of the petitioner, case in Cr.No.31 of 2018 was registered against the accused and during the course of investigation, it revealed that there is civil suit between the petitioner and the accused, and as the matter is of purely civil in nature, proposals were submitted before the Assistant Commissioner of Police, Shamshabad Division, for permitting the investigating agency to refer the complaint as 'civil in nature' and the same is pending consideration. It is stated that appropriate report under Section 173 of Cr.P.C. will be filed before the court, at the earliest.
Recording the above statement, writ petition is disposed of directing the 3rd respondent to file report under Section 173 of Cr.P.C. after issuing notice to the petitioner and it is open to the petitioner to avail alternative remedies available under law.
