HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 25322 OF 2017 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the respondents in not referring the petitioner's case to the Corporate Medical Board of the respondents company as illegal and arbitrary. Heard learned counsel for the petitioner and Sri J.Srinivasa Rao, learned Standing Counsel for the respondents.

It is the case of the petitioner that he joined in the service of the respondent company and now he is working as Pump operator at Sri Rampura-3 Incline Area and he met with a motor vehicle accident on 03.03.2008 and sustained injury to his left leg. He is also suffering from heart problem, asthama and that he has been treating in the 1st respondent's Area Hospital It is stated that though the respondent company incorporated Voluntary Retirement Scheme in the year 2016, the same was struck down by this Court and providing dependant employment. That the petitioner made a representation to the respondents on 30.06.2017 for discharging him from the service as he is suffering with several ailments and also for referring him to medical examination board, but the same is not considered

till date and no orders are passed. Aggrieved by the same, present writ petition is filed.

It is stated by the learned counsel for the petitioner that the 3rd respondent is competent to consider the representation of the petitioner.

Since the grievance of the petitioner is already pending before the respondents, the 3rd respondent is directed to dispose of the representation of the petitioner dated 30.06.2017 and take action in accordance with law. With the above direction, this writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
