Petitioners claim that they own agricultural land to an extent of Acs.3.10 cents in Survey No.305 of Bhogapuram Village, Pithapuram Mandal, East Godavari District. They allege that they are unable to cultivate their lands because of the village drainage flowing into their lands. The averments made in the affidavit filed in support of the Writ Petition and the material papers enclosed thereof, do not disclose that petitioners have approached the competent authority ventilating their grievance. Whether there was any drainage leading into their lands or such drainage was created only in the recent past affecting their lands and whether proper procedure was followed while leading the drainage, require consideration.

For examination of the matter and taking appropriate decision by the revenue authorities, the petitioners ought to have ventilated their grievance before the District Collector. Therefore, this Court is not inclined to entertain the Writ Petition and examine the grievance, at this stage, even before the alleged violation of the right of the petitioners to enjoy the property is ventilated and invited response from the authorities. 3.

The Writ Petition is disposed of leaving it open to the petitioners to ventilate their grievance as projected in the Writ petition. It is needless to observe that as and when such grievance is ventilated, the competent authority shall look into the same and

- 3 - take appropriate decision as warranted by law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
