THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION Nos.14920 and 14931 of 2011 COMMON ORDER:
Mr. Venugopala Rao Pasnooru, appearing for petitioners, after perusing the stand taken in the counter affidavit, submits that the issue of title to property is required to be considered and determined in a properly instituted suit before competent civil Court. He requests the Court to give liberty to petitioners to file a comprehensive suit before the competent Court.
2. I have perused the counter affidavit filed by respondent No.2 and this Court is of the view that the disputed question of title to property is to be considered and decided in a properly instituted suit. The writ petition is disposed of by giving liberty as prayed for. It is made clear that the disposal of writ petition shall not be understood as this Court expressing a view by reference to the stand taken in the counter affidavit on the title claimed by the petitioners. It is to be independently considered and decided. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
