HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27844 of 2017 ORDER:
The inaction of respondents, in finalizing the tender notification dated 13.06.2013, and trying to allot to third parties, is questioned in this writ petition as being illegal and arbitrary.
Sri T.Mahender Rao, learned Standing Counsel appearing for respondent - National Institute of Technology, would submit that the tender could not be finalized on account of injunction having been obtained by the then contractor; and, recently, an agreement was reached under which the contract of the existing contractor was extended for a period of one year valid till 07.07.2018. He would submit that all other tenderers have taken back their earnest money deposit on account of pendency of suit except the petitioner, and the petitioner shall approach respondents for return of earnest money deposit. The submissions now made, on account of changed circumstances, whether to continue the original tender notification or issue fresh notification could only be after 07.07.2018.
Recording the submissions of the learned Standing Counsel, the Writ Petition is closed. However, petitioner is
at liberty to approach respondents for return of earnest money deposit.
Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
