THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 13848 of 2016 ORDER:

The prayer of the petitioner in this case is as under; "Hon'ble Court may be pleased to issue a writ, order or direction more so, a writ in the nature of mandamus, by declaring the action of the 2nd and 3rd respondents in not considering the representation of the petitioner to receive the application from the petitioner for TET Test examination conducted by the 1st respondent, as arbitrary, illegal and inequitable and unjust and to direct the respondents to consider the application of the petitioner forth with and may pass such other order or orders as this Hon'ble Court may be pleased to deem fit and proper in the interests of justice and equity."

2.

It is an admitted fact that the petitioner submitted her application beyond the last date stipulated by the authorities. The last date was 30.03.2016, whereas the petitioner claims to have submitted her application on 31.03.2016.

3. In that view of the matter, this Court finds no illegality on the part of the authorities in not accepting the petitioner's application. However as the petitioner seems to have submitted representation, dated 31.03.2016 to the authorities seeking sympathetic consideration of her case and to accept her application, it is for the authorities to consider such application, if permissible, and take appropriate action thereon. With the said observation, the Writ Petition is closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
