THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12062 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.257 of on the file of Abdullapurmet Police Station, Rachakonda, registered for the offence under Section 8(c) r/w. 20 (b) (ii) (c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
The petitioner and two others were arrested by Abdullapurmet Police for being found in possession of 2 packets of ganja amounting to 22 kgs. Having followed the procedure prescribed under NDPS Act, according to Police, they were remanded to judicial custody. The Police on completion of investigation filed charge sheet.

Learned counsel appearing for the petitioner would submit that except this petitioner, all the others were released on bail.

The said aspect was not disputed by the learned Additional Public Prosecutor.

On the ground of parity, this Court is inclined to grant the relief of regular bail, subject to following conditions:
i) The petitioner/accused No.3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties i.e., one local surety and the other from the native place, for a like sum each to the satisfaction of Metropolitan Sessions Judge at L.B.Nagar.
ii) The petitioner/accused No.3 after release shall appear before the concerned Court on every date of hearing iii) The petitioner/accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
