THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.45117 of 2016 ORDER:
Petitioners complain against the seizure of vehicles bearing Nos.AP 37 TB 1283 and AP 37 TC 2169 without procedure as illegal, arbitrary and unconstitutional.

Learned Government Pleader (Mines and Geology), on instructions, submits that the seizure of vehicles is on account of extraction of sand from unauthorized areas and the petitioners have to apply for appropriate orders under G.O.Ms.No.42 Industries and Commerce (Mines-II) Department dated 29.03.2016 and after such request is made to respondents 3 and 4, the same will be considered and orders are passed within one week from such representation.

The statement in placed on record. Petitioners are given liberty to represent to respondents 3 and 4 for release of vehicles within one week from today and on such representation being made by petitioners, respondents 3 and 4 pass order within seven
(7) days from the date of receipt of copy of the representation. If the petitioners are required to comply with condition, respondents 3 and 4 are further directed to release the vehicles after the
petitioners comply with the condition imposed by respondents 3 and 4.
The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
