THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 6207 OF 2017 O R D E R :

This Writ Petition has been filed seeking a direction to the respondents to consider the representation dated 09.05.2016 submitted by the petitioner to remove the encroachments on NH-7 road margin at KM Stone 325 near Pamidi Town, Anantapur District.

The petitioner claims to be the owner and pattedar of land in an extent of Acs.6.79 cents in Survey Nos. 1248/1, 1249/1 and 1250/1 of Padmidi Village and Mandal, Anantapur District. It is stated that NH-7 is abutting his land on Eastern side. According to him, houses and huts are being constructed by encroaching NH-7 road margins at KM Stone 325 near Pamidi Town, causing a lot of inconvenience and obstruction to the road users in general and to him in particular. He therefore, submitted the representation dated 09.05.2016 to the 2nd respondent Superintending Engineer, Roads & Buildings, Anantapur to take necessary action, but so far, the same has not been attended to. Heard learned counsel for the petitioner as well as learned Government Pleader for Roads & Buildings for Respondents 1 to 3.

Since the grievance set out in this Writ Petition being limited, this Court is of the view that the ends of justice would be better served if a direction is issued to the respondents to consider the representation dated 09.05.2016 of the petitioner. The respondents are therefore, directed to consider the representation dated 09.05.2016 of the petitioner.

taken in accordance with law for removing the encroachments along side NH-7 within 12 weeks.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
