HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19919 of 2017 ORDER:

This writ petition is filed challenging the action of the respondents in interfering with the possession of the petitioners over their shops situated at Meda Street, Kalyandurgam, Ananthapuram District, without following the due process of law.

It is the case of the petitioners that on 8.6.2017, the officials from the office of the 3rd respondent came to their shops and started taking some measurements without any intimation, and when the petitioners questioned them, they informed that their shops are required for widening of the road. Further, the said officials directed the petitioners to vacate the premises within two weeks. Hence, the petitioners filed this writ petition.

Heard and perused the material available on record. 4.

The main grievance of the petitioners is that the respondents are trying to dispossess them and demolish their shops, without following the due process of law.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the Writ Petition is disposed of directing the respondents to follow the due process of law, if they intend to acquire the shops of the petitioners.
