O R D E R

Aggrieved by the action of 4th respondent - Sub Inspector of Police, Charminar, Hyderabad, in summoning the petitioners to the police station and insisting them to discharge the debt to unofficial respondent No.5 without following the procedure under law, the present writ petition is filed.

Head the learned counsel for the petitioners. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Charminar Police Station, dated 18.08.2018, stating that the unofficial respondent No.5 lodged a report and based on the same, case in Cr.No.110 of 2018 was registered on 23.07.2018 against the petitioners for the offences punishable under Sections 120-B, 419, 420, 343 384 read with 511, 506 read with 34 IPC and taken up the investigation and during the course of investigation notices under Section 41-A of Cr.P.C, were served on petitioners and instead of co-operating with the investigation, they filed the present writ petition, making false allegations. The allegations of the petitioners that 4th respondent is summoning the petitioners to police station and insisting to discharge the debt of unofficial respondent No.5 without following the procedure, is denied.

In view of the statement made in the written instructions, it is open for the petitioners to appear before the police in pursuance of notices under Section 41-A of Cr.P.C.

However, the police shall not insist/ pressurize the petitioners to settle civil dispute with 5th respondent, or interfere with the civil dispute between the petitioners and 5th respondent.

Recording the statement made in the written instructions and with the above observations, writ petition is disposed of. Interlocutory applications pending, if any, shall stand closed. No costs.
