This criminal petition is filed under Section 480 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/accused No.7 seeking enlargement on bail in SC.No.111 of 2021 on the file of learned VIII Additional Chief Judicial Magistrate, Ranga Reddy District,

Chevalla. The offence alleged against the petitioner is under Section 395 of the IPC.

The brief facts of the case are that on 07.01.2021, a de-facto complainant, CEO of Cashmeree Court Venture in Mokila Village for the past 13 years, reported a theft incident. The venture has been constructing villas in Survey Nos.131, 132, 133, and 134 for the last three years, with three security guards working in shifts. Mr. Kishan Bora and his wife Devi reside in the security supervisor's room. During the night of 06/07.01.2021, guards Rup Jyoti Bora, Prakash Bora, and Poragnath Seri (alias Mrialnath) were on duty. Around 01:00 AM, while Prakash and Poragnath were patrolling, seven unidentified individuals entered the premises by scaling the rear wall. They proceeded to the main gate, assaulted and tied up Rup Jyoti Bora, and threatened him. They also beat Kishan Bora, tied him with a shirt, assaulted his wife Devi, and stole Sq Wire - 92 units, 2.5 Sq Wire - 138 units, 4 Sq Wire - 191 units and 6 Sq Wire - 48 units, worth of Rs.5,00,000/- from the room of the supervisor. The intruders tampered with CCTV

cameras and fled in an unidentified vehicle, as such requested for necessary legal action.

Heard Sri Thakur Viaks Singh, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

Learned counsel for the petitioner submitted that the trial Court had issued a Non-Bailable Warrant (NBW) in S.C.No.111 of 2021 against the petitioner, who was apprehended on 21.03.2025 and remanded to judicial custody. The petitioner has been in custody for over five months and the petitioner has not attended the trial Court, as he was not aware of the date of trial and the petitioner is ready to appear before the trial Court on every date of adjournment and he is ready to cooperate with the prosecution. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that because of the

petitioner herein the case has been pending since 2021. He further submitted that releasing the petitioner on bail may lead to tampering with evidence or intimidation of witnesses and again the petitioner may not attend the trial Court and prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, earlier the bail petition was disposed of by this Court vide order dated 19.09.2025 by directing the trial Court to consider the same as expeditiously as possible and the Daily Status filed by the learned Public Prosecutor shows that there is no such stage in the trial. Considering the stage of the trial, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of learned VIII Additional Chief Judicial Magistrate, Ranga Reddy District, Chevalla.

ii.

The petitioner shall appear before the trial Court on every date of adjournment and to cooperate with the trial Court in conclusion of the trial.

iii.

The petitioner shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
