THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4860 OF 2016 ORDER:

This Writ Petition, filed under Article 226 of the Constitution of India, challenges the alleged inaction on the part of the 2nd respondent in concluding the disciplinary proceedings in pursuant to the show-cause notice issued by the 2nd respondent vide R.C.No.D5/834/E.G.S/2015, dated 06.08.2015.

2. Heard Sri L.J.Veera Reddy, learned counsel, appearing for the petitioner and learned Government Pleader, appearing for the 1st respondent and Sri M.Sree Rama Chandramurthy, learned counsel, appearing for the 2nd respondent.

According to the petitioner, he was appointed as Field Assistant in Karumanchi Gram Panchayat, Tanguturu Mandal, Prakasam District, under Mahatma Gandhi National Rural Employment Guarantee Scheme in the year 2006 and he has been working without any complaint or remark. The 2nd respondent - Project Director, District Water Management Agency, Prakasam District, by virtue of proceedings vide R.C.No.D5/834/E.G.S/2015, dated 06.08.2015, directed the petitioner herein to submit explanation with regard to the certain allegations, while keeping the petitioner under suspension. According to the petitioner, he attended before the 2nd respondent on 29.08.2015 and submitted an explanation. The only grievance of the petitioner in the present writ petition is non-conclusion of the enquiry by the 2nd respondent, despite lapse of considerable length of time.

4. In view of the nature of relief sought, this Court is of the considered opinion that the ends of justice would be met, if a direction

is issued to the 2nd respondent to conclude the enquiry by fixing some timeframe.

For the aforesaid reasons and facts and circumstances of the case, Writ Petition is disposed of, directing the 2nd respondent herein to conclude the disciplinary proceedings initiated against the petitioner, pursuant to the proceedings vide R.C.No.D5/ 834/E.G.S/2015, within a period of two months from the date of receipt of a copy of this order.

6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 16.02.2016 SS
