HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5682 OF 2017 ORDER:
This writ petition is filed challenging the notice No.B/357/2017, dated 14.02.2017, issued by the 3rd respondent wherein the petitioner was asked to submit explanation as to why patta granted to her should not be cancelled.
Learned counsel for the petitioner submits that the Revenue Divisional Officer has no power to issue the impugned notice.
Learned Assistant Government Pleader for Revenue produced Rules regarding assignment of house sites in village and towns in Telangana Area, wherein it is provided that the Revenue Divisional Officer has power to revoke the pattas. Even the Patta conditions also goes to show that the Revenue Divisional Officer has power to revoke the pattas in case of violation of conditions.
In view of the same, it is open for the petitioner to submit explanation to the impugned notice, within four weeks from today and on such explanation being filed by the petitioner, the 3rd respondent shall pass final orders after affording opportunity of hearing to the petitioner. Till passing of final orders, status quo obtaining as on today shall be maintained.
Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
