THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 9852 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.2 to 4 in the event of his arrest in Crime No.925 of 2022 on the file of Station House Officer, Chanda Nagar Police Station, Cyberabad, registered for the offence punishable under Section 304-B IPC and Section 498-A IPC. 2.

Heard learned counsel for petitioners/Accused Nos.2 to 4 and learned Additional Public Prosecutor for respondent-State. Perused the record.

The Station House Officer, Chandanagar Police Station has registered present crime on the basis of complaint stating that his daughter was married to accused No.1 and they were staying at Chandanagar. Accused No.1 used to abuse the deceased in filthy language and was also frequently beating her. A daughter was born and all the accused along with accused No.1 and the deceased went for tonsure ceremony and thereafter, returned to their respective houses.

Admittedly, the deceased and accused No.1 were staying at Chandanagar and even according to the police, petitioners are residents of Ananthapur District residing in Pulikuntapally Village which is at about 300 kms far from Chandanagar. Except stating that these petitioners were abating the harassment meted out by accused No.1, there are no specific allegations against the petitioners is concerned. In the said circumstances, the petitioners can be granted for anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 to 4 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.2 to 4 are directed to surrender before the Station House Officer, Chandanagar Police Station, Cyberabad within ten (10) days from today, and on such surrender, they shall be enlarged on bail on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum each, to its satisfaction. ii) On such release, the petitioner/Accused No.2 shall appear before the concerned Station House Officer on every Monday at 10.00 AM for a period of six weeks and the petitioner Nos. 1 & 3, who are accused Nos. 2 & 4 shall appear before the concerned

Station House Officer as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.2 to 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 15.11.2022 PKR
