THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12089 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner - accused No.1 seeking anticipatory bail in the event of his arrest in connection with Crime No.683 of 2023 on the file of Station House Officer, Mahabubnagar Rural Police Station, Mahabubnagar District. The offences alleged against the petitioner are under Sections 448, 324, 427, 506 and 379 read with Section 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for respondent - State and perused the record.

The complaint was lodged with the Mahabubnagar Rural Police Station stating that the petitioner who is the brother of local MLA had trespassed into the house of the de facto complainant and damaged the property and also threatened to kill her. The CC TV footage data was also damaged.

Learned counsel appearing for the petitioner would submit that due to political rivalry a false complaint is filed and the

Crl.P.No.12089_2023 petitioner was not even present when the incident had taken place. Therefore, prayed to grant bail to the petitioner. 5.

However, keeping in view that there are no details of property which was subjected to theft in the complaint and it appears that there are political differences, this Court is inclined to grant the relief of anticipatory bail to the petitioner - accused No.1 in the event of this arrest, subject to the following conditions: i) The petitioner - accused No.1 is directed to surrender before the IV Additional Judicial Magistrate of First Class at Mahabubnagar on or before 18.12.2023. Upon such surrender, the Court concerned shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.

ii) On such release, the petitioner - accused No.1 shall appear before the concerned police on every Monday between 10.30 AM and 01.00 PM for a period of four (04) weeks for the purpose of investigation and thereafter, as and when required.

Crl.P.No.12089_2023 iii) Further, the petitioner- accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
