HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29248 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in issuing notice dated 6.8.2018 seeking to survey and demarcate the petitioner's land admeasuring Ac.12.11 cents situated at Sy.No.191/F1 and 191/F3 of Peddakothilaki Revenue Village, Nandavaram Mandal, Kurnool District, as illegal and arbitrary. The only ground urged by the learned counsel for the petitioner is that the notice dated 6.8.2018, came to be issued at the instance of the 6th respondent, for the property which was already sold to the writ petitioner and as such the 6th respondent has no locus to seek the survey of the subject land.

Since the respondents issued only a show cause notice to the petitioner, the petitioner is at liberty to bring it to the notice of the concerned Surveyor and also to the notice of the Mandal Revenue Officer by placing all the relevant records, to show that they have no authority to conduct the survey of the subject land, at the instance of the 6th respondent. On making such representation along with the supporting documents, the respondent-authorities shall deal with the issue viz. as to whether any survey can be conducted, at the instance of the 6th respondent and proceed in accordance with law. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
