HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29246 OF 2018 ORDER:

1) The present writ petition came to be filed seeking to declare the action of the respondents in trying to dispossess the petitioner by demolishing the asbestos roofed shed and the foundation, situated in plot No.34 in Sy.No.181 of China Mushidiwada Village, Pendurthi Mandal, Visakhapatnam District without following the due process of law, as illegal and arbitrary. 2) Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

3) Though various grounds are raised, the learned counsel for the petitioner submits that the respondents are trying to dispossess the petitioner from the tin shed raised by her, forcefully and also trying to demolish the same without following the due process of law. According to him, the petitioner was assigned the said plot in the month of October, 1986 and since then she has been in possession and enjoyment of the same. The petitioner has also raised a asbestos roofed shed in the said plot and staying there, but for reasons best known, the 4th respondent-Tahsildar along with the other officials are trying to demolish the said shed and dispossess the petitioner highly handedly. 4) Learned Government Pleader for Revenue would submit that the documents filed by the petitioner along with the writ petition do not indicate that the petitioner is in possession of the same.

5) Having regard to the facts and circumstances of the case and without going into merits of the case, the writ petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioner's shed, if the petitioner is in possession, except following the due process of law. 6) With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed. ____________________ C. PRAVEEN KUMAR, J 17.08.2018 gkv
