HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.737 of 2015 in Crl.P.No.719 of 2015 and Criminal Petition No.719 of 2015 COMMON ORDER:

The defacto complainant and his counsel Sri P.Srinivasulu are present. A.2 and A.3 and their counsel Sri K. Nagendra Prasad are present.

On the report given by de-facto complainant, the Police of Mancherial P.S, Adilabad District registered Crime No.408 of 2014 against accused for the offences under Sec.420, 468 and 471 IPC and investigation is reported to be pending. The allegation is that A.2 and A.3 forged the photo of the mother of the complainant and sold her land to A.1 and thus cheated the family of the complainant.

While-so, now the parties and their counsel appeared in Court today and submitted that at the intervention of elders, they have amicably resolved the dispute pertaining to the land whereunder the complainant admits that in fact his mother sold her land under an un-registered document wayback on 09.12.1968 to the A.2 and A.3 and as such he has no grievance against the accused who are his close relations and therefore, there is no objection for quashment of the proceedings in Crime No.408 of 2014 and hence permission may be accorded and proceedings may be quashed in the interest of justice.

Having regard to the above said submission of the parties and in view of the fact that the matter relates to property dispute among the close relations and as the parties have amicably resolved their disputes and also considering that no useful purpose will be served if the investigation is ordered to be continued since the parties have compromised and following the decision reported in Gian Singh v. State of Punjab and another[1], this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in Crime No.408 of 2014 on the file of Mancherial P.S, Adilabad District are hereby quashed in terms of joint memo filed by the parties.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
