THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITON No.13783 of 2024 ORDER :
This petition is filed seeking to reduce the surety amount from Rs.50,000/- with two sureties to that of Rs.5,000/- with two sureties.

Heard Sri M.Ramesh Babu, learned counsel for petitioner and Sri V.T. Kalyan, learned Special Public Prosecutor representing Mr. Dominic Fernandes, learned Standing Counsel for Customs Department and perused the record.

The trial Court, by order, dated 03.07.2024 in HQPOR No.17 of 2024 in AIRCUS/49/ADJN/138/2024-AIU-C, while granting bail to the petitioner/accused, directed him to furnish two sureties of Rs.50,000/-. Petitioner seeks to relax the said condition as stated above.

It is contended by the learned counsel for petitioner that the petitioner is a poor person, due to which, he is not in a position to furnish two sureties for Rs.50,000/-, as the same is very huge amount for him.

In view of the above and in the facts and circumstances of the case, this Court is of the considered view that it is a fit case to reduce the surety amount.

Accordingly, this petition is allowed and the impugned order, dated 03.07.2024 is modified to the effect that the petitioner shall furnish two sureties for Rs.15,000/-.
