THE HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7275 of 2016 ORDER:

This Criminal Petition is filed under Section 438 Cr.P.C by petitioners/A.2 and A.3 seeking anticipatory bail in connection with a case in Crime No.242/2015 of Women Police Station, Cyberabad, registered against the petitioners and others for the offences punishable under Sections 498-A and 506 IPC and Sections 4 and 6 of the Dowry Prohibition Act.

2. Heard learned counsel for the petitioners, the learned Additional Public Prosecutor for the Respondent-State and perused the material placed on record.

3. The petitioners went unsuccessful in seeking Anticipatory bail before the learned V Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar vide order, dated 04.05.2016, in Crl.M.P.No.776 of 2016 in Crime No.242 of 2016.

4. A perusal of the impugned order shows that A.1 is absconding and the relief of Anticipatory bail sought for by the petitioners herein was negated.

5. In fact, a perusal of the bail application shows that A.1 is in United States of America and he already moved an application for divorce against the daughter of de facto complainant, which is pending in District Court of Colorado, United States of America.

6. Having regard to the circumstances stated in the petition as well as submissions made by the learned counsel, instead of dismissing from not entitled to the pre-arrest bail, but for regular bail in considering petitioners' personal liberty, this application is disposed of, by giving liberty to the petitioners-A.2 to A.3 to surrender before the Learned Magistrate concerned to take into custody under Section 44 Cr.P.C by virtue of this order, move before the learned Magistrate for regular bail and with notice to learned

Assistant Public Prosecutor concerned and in such an event, the learned Judge/Magistrate shall consider for granting of bail in favour of the petitioners with necessary conditions preferably on the same day if not at least by the next day with necessary conditions. Miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
