THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITON No.13721 of 2024 ORDER :

This petition is filed seeking to reduce the surety amount from Rs.2,00,000/- with two sureties each to that of Rs.20,000/- with two sureties each.

Heard Sri M.Ramesh Babu, learned counsel for petitioners and Sri V.T. Kalyan, learned Special Public Prosecutor representing Mr. Dominic Fernandes, learned Standing Counsel for Customs Department and perused the record.

The trial Court, by order, dated 23.10.2024 in Crl.M.P.No.359 of 2024 in File No.DRI/HZ/48A/ENQ-38 (INT38/2024 in FN DRI No.9/2024), while granting bail to the petitioners/accused Nos.1 and 2, directed them to furnish two sureties of Rs.2,00,000/- each. Petitioners seeks to relax the said condition as stated above.

It is contended by the learned counsel for petitioners that the petitioners are poor persons, due to which, they are not in a position

In view of the above and in the facts and circumstances of the case, this Court is of the considered view that it is a fit case to reduce the surety amount.

Accordingly, this petition is allowed and the impugned order, dated 23.10.2024 is modified to the effect that the petitioners shall furnish two sureties for Rs.25,000/- each.
