THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.26804 OF 2013 ORDER:

Present Writ Petition came to be filed under Article 226 of the Constitution of India seeking to declare the action of the respondents in not releasing the death benefits including family pension under Employees Provident Fund & Misc. Provisions Act, 1952 as illegal and arbitrary.

The dispute in the instant case was with regard to Form-D submitted by the petitioner. In the counter filed by the first respondent, they claim that they never received Form-D i.e. Pension papers whereas respondents 2 to 4 filed counter stating that they sent Form-D to R.1. On 20.04.2017, this Court directed the respondents to trace out the 10-D form submitted by the petitioner and process the same for payment of family pension to the petitioner, to which she is entitled to.

Today, when the matter is taken up for hearing, Sri S.V.Ramana, learned Standing Counsel, produced a copy of letter dated 21.04.2017 addressed by the Secretary, EPF Trust, to the Senior Law Officer, APSRTC, Hyderabad, stating that the claim of the petitioner in Form 10-D was processed and forwarded to RPFC, Hyderabad, and the petitioner is already drawing the EPS-95 pension vide Pension Pay Order No.AP/HYD/141000010171/TRANSOUT/60 dated 15.10.2014. In view of the letter dated 21.04.2017, no further orders need be passed in this writ petition.

Accordingly, the Writ Petition is closed.

Miscellaneous Petitions pending in this petition, if any, shall stand closed. No order as to costs.
