HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner is one of the candidates participated in the selection for recruitment as Secondary Grade Teacher (SGT) pursuant to the notification No.53/2017, dated 21.10.2017. According to petitioner, he belongs to Mahabubnagar district. In the selections conducted by the Public Service Commission, petitioner secured 50.761 marks and within the zone of selection to be short listed for certificate verification in the ratio of 1:3 against BC-C (Male) vacancies. According to petitioner, during the existence of combined State of Andhra Pradesh, he was issued social status certificate on 07.05.2014 describing him as Scheduled Caste. Based on the social status certificate, he applied for the post describing him as Scheduled Caste. 2.

Petitioner now claims that he applied for issuance of fresh social status certificate after formation of State of Telangana. Whereas he was awarded BC-C category certificate on 07.08.2018 treating him as converted Christian. Based on the certificate issued now, petitioner claims that he should be treated as a person belonging to BC-C category and be considered accordingly. 3.

Facts as noted above make it clear that when he applied to the post, he has described himself as Scheduled Caste category candidate based on the certificate granted to him in the year 2014. There was no challenge made to the said certificate. It is not cancelled. It is not the case of petitioner that the social status claimed by him to obtain certificate in the year 2014 is changed consequent to formation of State of Telangana requiring him to

apply for fresh caste certificate. There is no requirement to obtain fresh caste certificate in the State of Telangana unless there is change in the social status of the caste of a person. The selection process was set in motion long ago and at the stage of certificate verification, petitioner cannot claim himself to be treated as BC-C category contrary to his declaration. If social status now claimed by petitioner is true, it also amounts to suppression of true and correct facts while submitting his application describing his social status as belonging to Scheduled Caste when recruitment process was taken up.

For the aforesaid reasons, relief sought by the petitioner cannot be granted. Writ petition is dismissed accordingly. Pending miscellaneous petitions shall stand closed.
