THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13267 OF 2025 ORDER :

This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking regular bail in connection with Crime No.1230 of 2025 of Meerpet Police Station, Rachakonda District. The offences alleged against the petitioner are under Section 69 of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the defacto complainant lodged a complaint on 24.09.2025 stating that she got acquaintance with the petitioner herein from October 2024. That she is a 3rd year B.Tech student and the petitioner is a 1st year B.Tech student, they both developed physical relationship in the guise of marriage from November 2024 and in the month of June 2025, she came to know that she is three months pregnant and when the complainant called the petitioner, he did not respond to her call. As such, she requested the police to take necessary action against the petitioner basing on which, police registered the case against the accused for the above offence.

Heard Sri Rapolu Bhaskar, learned counsel for the petitioner and Sri D.Arun Kumar learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that whatever relationship between the petitioner and defacto complainant is a consensual relationship and that there is no mention in the complaint that petitioner herein refused to marry her and even today, he is ready to marry her. The petitioner is in jail from 25.09.2025 and material part of investigation is already completed. Hence, requested this Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offence is heinous in nature and because of the petitioner, the complainant is conceived and she is three months pregnant and when she requested to marry her, petitioner refused to marry her. As such, prayed this Court to dismiss this petition. 6.

Considering the submissions made by both the counsel and the material placed on record, petitioner and defacto complainant are in relationship from November, 2024 and as seen from record, petitioner is in jail from 25.09.2025 and

- 3 - material part of investigation is already completed. Hence, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

i.

The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of VI Additional Metropolitan Magistrate, Ranga Reddy District at L.B.Nagar.

ii.

The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
