THE HONOURABLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE NO.114 OF 2017

O R D E R

This contempt case was instituted alleging willful disobedience to the order dated 02.12.2017 passed in W.P.No.39093 of 2015. By the said order, the police authorities were directed to abide by the directions of the Supreme Court in LALI TA KUMARI V/ s. GOVERNMENT OF UTTAR PRADESH1. The grievance of the petitioner in that case was that the police authorities had not registered an FIR on his complaint dated 21.03.2015.

The Inspector of Police, Ibrahimpatnam Police Station, filed a counter-affidavit stating that upon the complaint lodged by the petitioner, Crime No.88 of 2015 was registered under Sections 448, 323, 506 read with Section 34 IPC on the date of the complaint itself, viz., 21.03.2015. However, after investigation, a final report was filed in accordance with the due procedure before the learned IV Metropolitan Magistrate, Cyberabad at Ibrahimpatnam, vide Inward No.2325/2015 dated 11.09.2015, stating that the complaint was false. In the light of the aforestated steps taken by the police authorities, no disobedience, much less willful disobedience, is established in so far as the directions of the Supreme Court in LALI TA KUMARI 1 are concerned.
