THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14018 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the entire action of the respondents, particularly the entire action of the 1st respondent in not considering the case of the petitioner for promotion to the post of School Assistant (Telugu) even though she is fully eligible, qualified and senior most person in the feeder category, inspite of availability of vacancy in the said cadre since long time inspite of request from the petitioner as highly illegal, arbitrary, unjust, improper, violative of all principles of natural justice and consequently to direct the respondents to forthwith consider the case of the petitioner for promotion to the post of School Assistant (Telugu) in the existing vacancy caused due to retirement of one Smt. Rose Mary, by duly considering the representation of the petitioner dated 14.3.2016."

Heard Sri S. Satyanarayana Rao, learned counsel for the petitioner and learned Government Pleader for Education for respondents.

When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 1403-2016 to the 1st respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 1st respondent to pass appropriate orders on the representation, dated 14-03-2016, in accordance with law, by fixing some timeframe. The said

request is not opposed by learned Government Pleader for respondents and submitted that the said representation would be considered, in accordance with law.

For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the 1st respondent to consider and pass appropriate orders on the representation, dated 14-03-2016 said to have been submitted by the petitioner herein, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
