THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13206 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.3 in FIR No.427 of 2025 of Chilkalguda Police Station, Hyderabad District, registered for the offences punishable under Sections 61(2), 111, 316(5), 318(4), 336(3), 338 r/w 3(5) of BNS. 2.

The brief facts of the case are that, on 20.08.2025, the de-facto complainant lodged a report before the police stating that accused Nos.1 to 3 have availed personal loans from the bank by submitting fabricated salary account statements, Pay slips and other employment related documents and have forged the documents and they have cheated and caused loss of Rs.20,11,417/-, Rs.24,68,110/- and Rs.24,96,406/- to the bank respectively. Hence, he requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Smt. A. Latha, learned counsel appearing on behalf of the petitioner/accused No.3 as well as Sri E. Ganesh, learned Assistant Public Prosecutor for respondentState.

Learned counsel for the petitioner submitted that the petitioner/accused No.3 is the wife of accused No.10 and she is not aware of any allegations against her and the petitioner being a wife of accused No.10 has handed over her Aadhar Card and Pan Card to her husband, except that, she is not aware of obtaining loan from the bank and she is in jail from 13.09.2025 and she is also one month pregnant. Therefore, he prayed the Court to grant bail to her by allowing this criminal petition.

On the other hand, learned Assistant Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against her are serious in nature. It is further submitted that she is also involved in the said conspiracy and she was shown as an employee of Tech Mahindra and she is not an employee of Tech Mahindra. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein was shown as an employee of Tech Mahindra for obtaining loan from the Bank

and the bank, basing on the documents furnished by the other accused has sanctioned loans and she is in jail from 13.09.2025. Further, as seen from the medical certificate filed by the petitioner, she is pregnant as on the date of her remand. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner/accused No.3, subject to the following conditions.

i.

The petitioner/ accused No.3 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned X Additional Chief Judicial Magistrate, at Secunderabad.

ii.

The petitioner/ accused No.3 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for

the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/ accused No.3 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
