THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3274 of 2015 ORDER:
Impugning the action of the 5th respondent in refusing to receive the documents pertaining to land in an extent of Ac.0-61 cents in Survey No.369/9, 10 and 11 of Kothapalem village, Chirala mandal, Prakasam district, from the petitioner for the purpose of registration, this writ petition is filed.
2. The 5th respondent, under the Registration Act, 1908, cannot refuse to receive the documents presented for registration. If he has any objection with regard to registering the documents, he is duty bound to communicate the reasons, in writing. Hence, the petitioner shall approach the 5th respondent and present the document for registration; upon which the 5th respondent shall follow due process of law; and if there is any objection to register the document, he shall forthwith communicate the reasons for not entertaining the documents, in writing.
3. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
