THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.12236 of 2017 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the action of the respondents 2 & 3 in not conducting enquiry on the unauthorised constructions being carried on by respondents 4 & 5 in Sy.No.115/2 & 3 of Khairatabad Village & Mandal, Hyderabad District pursuant to the representation of the petitioner dated 02.12.2016 as arbitrary and illegal and consequently, to direct the respondents 2 & 3 to conduct an enquiry on the unauthorised constructions being carried on by the respondents 4 & 5 in Sy.No.115/2 & 3 of Khairatabad Village & Mandal, Hyderabad.

Heard and perused the material available on record. The main grievance of the petitioner is that the respondents 4 & 5 obtained construction permission in respect of land in Sy.No.112 or its part, and under the guise of said permission, they have started construction in Sy.No.115/2 & 3 of Khairatabad, Hyderabad. Even though the petitioner made a representation to the respondents 2 and 3 pointing out the above illegal activities of respondents 4 & 5 by application dated 02.12.2016, so far, no action has been taken. Considering the facts and circumstances of the case, the respondents 2 & 3 are directed to consider the representation of the petitioner dated 02.12.2016 and if the respondents 4 & 5 are carrying on the construction activities without obtaining any sanction plan or if there is any violation or deviation in the said construction activities, as alleged by the petitioner, they are at liberty to issue required notices to the respondents 4 & 5 and take necessary action in accordance with law.

The writ petition is disposed of accordingly. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 12.06.2017 Tsr
