Learned counsel for the petitioner-accused No. 2 has requested for permission of this Court to withdraw the criminal petition with liberty to his client to file application under Section 70 (2) of Cr.P.C. before the Court below. The criminal petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made and on filing such application, the Court below is directed to dispose of it on the same day in accordance with law on appearance of the petitioner.
