HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.5345 of 2015 ORDER:
This writ petition is filed to declare the action of the 3rd respondent in not issuing despatch permits for transportation of mineral colour granite from the quarry leased area over an extent of Ac.16.60 in Sy.No.1 of Sontinur Village, Nandigama Mandal, Srikakulam District, pursuant to the quarry lease granted by the 2nd respondent vide proceedings 27.9.2008. When the matter came up for hearing, learned Government Pleader for Mines placed the brief note signed by the Assistant Director of Mines and Geology, wherein it was stated that the quarry lease has been determined by the Director of Mines and Geology, Ibrahimpatnam, vide D.Dis.No.7798/R1-1/2016, dated 6.10.2016 under Rule 12(5) (h) (xii) of APMMC Rules, 1966 and that the petitioner filed revision petition before the Government.
Learned counsel for the petitioner submitted that the revision petition is still pending before the Government and the petitioner may be given liberty to pursue legal remedies which are available to him, after disposal of the revision petition.
As the quarry lease is already determined by the Director of Mines and Geology on 6.10.2016 and despatch permits for transportation of
mineral colour granite were not granted to the petitioner, the writ petition is liable to be dismissed.
Accordingly, the Writ Petition is dismissed. However, the petitioner is given liberty to pursue remedies which are available to him, as per law, after the disposal of the revision petition.
