HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.13066 OF 2017 ORDER:

Heard the learned counsel for the petitioner and also the learned Standing Counsel for the 1st respondent and the learned Govt. Pleader for Civil Supplies for 2nd respondent and perused the impugned order, dt.22.02.2017 in L.M.No.PDS 1/ 16/ Chana Dal/ CSK-2017,dt.25.11.2016, the prayer in the Writ Petition, supporting affidavit and the other relevant material. The Writ Petition prayer reads as follows:- " to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus (i).declaring the action of the 1st respondent in seeking to black-list the petitioner from participating in future tender and forfeit the petitioner's Security Deposit and Earnest Money Deposit amounting to Rs.1,07,00,000/ -(Rupees one crore seven lakhs only) vide order dated 22.02.

2017 as being illegal, arbitrary and unconstitutional apart from being contrary to the Doctrine of Proportionality and set aside the same, (ii).declare the action of the 1st respondent in not considering the petitioner's request vide letter,dt. 10.12.2016 for extension of time and consequently issue proceedings dated 13.12.2016 as being as being illegal, arbitrary and unconstitutional apart from being contrary to the Doctrine of Proportionality and set aside the same.

(iii). Consequently direct the 1st respondent to refund petitioner's Security Deposit and Earnest Money Deposit amounting to Rs.1,07,00,000/ -(Rupees One Crore Seven Lakhs only) to the petitioner and pass any other order or orders as this Court may deem fit and proper in the circumstances of the case" .

From the hearing pursuant to the prayer supra, the Writ Petition is disposed of. The respondents shall consider the representation of the petitioner and pass appropriate orders. Needless to say the wording used in the order impugned herein

no way comes in the way for the petitioner's participation anywhere.

As a sequel, miscellaneous petitions if any pending in this Writ Petition shall stand closed.
