THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.7809 OF 2015 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to direct the Chief Metropolitan Magistrate, Hyderabad at Nampally to dispose of C.C.No.35 of 2013 by fixing a time frame.

Learned counsel for the petitioner contended that the accused is not appearing before the Court and on account of which the disposal of the case is being delayed and in support of his contention he filed the certified copy of the docket proceedings, which would clearly show that the accused was absent and filed petitions under Section 317 Cr.P.C. and the same were allowed. It is clear from the certified copy of the docket proceedings the accused was absent and filed 317 Cr.P.C. petitions for more than 30 occasions and they were allowed. On account of such indulgence shown by the trial Court for the accused the matter is not decided. Therefore, the Chief Metropolitan Magistrate, Hyderabad is directed to try and dispose of the C.C.No.35 of 2013 as per law as expeditiously as possible, preferably within a period of four (4) months from the date of receipt of a copy of this order. With the above directions, the petition is disposed of. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
