THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13212 OF 2025 ORDER :

This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.2 seeking regular bail in connection with Crime No.371 of 2025 of Punjagutta Police Station, Secunderabad. The offences alleged against the petitioner are under Sections 318(4) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that the defacto complainant lodged report before police on 15.05.2025 stating that he owns a Camera rental shop by name BC Camera Rentals, Pratap Nagar. On 28.04.2025, at about 6.00 p.m., a person by name Nithin Gattu approached his shop and requested for a camera for five days on rental basis and paid an advance of Rs.5000/- and took the equipment from him. Again on 01.05.2025 another person by name Javvaji Rajesh approached his shop and requested for a camera for two days on rental basis and paid an advance of Rs.6000/- and took another Camera but they have not returned the cameras as promised and their mobile phones were switched off. As such, requested the police to take necessary action against the said

- 2 - persons. Basing on the said complaint, police registered the case against the accused for the above offences. 3.

Heard Sri B.Mallesh Yadav, learned counsel for the petitioner and Sri D.Arun Kumar learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. The offence alleged against the petitioner is under Section 318(4) of BNS which is punishable with below seven years and instead of serving notice under Section 35 (3) of BNSS the police remanded the petitioner to judicial custody. The petitioner herein is falsely implicated in this case. As such, requested this Court to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor on instructions, would submit that the petitioner is involved in four crimes for the similar offences and he is a habitual offender. As such, petitioner is not entitled for bail and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material placed on record, the petitioner is in jail from 01.10.2025 and alleged offence is under Section 318 (4) of BNS.

- 3 - Though there are other crimes, the offences therein are under Sections 420 and 406 of IPC. Hence, considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner subject to the following conditions : i.

The petitioner/A.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of XIV Additional Chief Judicial Magistrate, Nampally at Hyderabad.

ii.

The petitioner/A.2 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.2 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, this Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
