ORDER:
This writ petition is filed with the grievance that respondent No.2 has not been considering the petitioner's representation on the legality or otherwise of the lease granted by the previous Management in favour of respondent Nos.3 and 4 and the
building permission granted by respondent No.2. In my opinion, respondent No.2 is not competent to decide the disputes raised by the petitioner either with regard to the validity of the lease or the building permission granted in favour of respondent Nos.3 and 4. The appropriate remedy for the petitioner is to file a civil suit seeking invalidation of the lease granted in favour of respondent Nos.3 and 4. The issue of validity or otherwise of the building permission will depend upon the outcome of such suit. Subject to the liberty given to the petitioner as above, the writ petition is dismissed.
As a sequel to dismissal of the writ petition, W.P.M.P.No.45400 of 2015 shall stand disposed of as infructuous.
