HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Crl.P.M.P.No.7966 of 2015 AND CRIMINAL PETITION No.7986 of 2015 COMMON ORDER :
This criminal petition is filed by the petitioners/A.1 to A.5 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.868 of 2010 on the file of the Chief Metropolitan Magistrate, Vijayawada, for the offence punishable under Section 420 IPC.
2. Pending the criminal petition, Crl.M.P.No.7966 of 2015 is filed by the petitioners and the 2nd respondent-de facto complainant and a joint memo along with the affidavit of the de facto complainant, wherein she stated that the matter is amicably settled out side the Court and in view of the compromise, petitioners paid Rs.13,00,000/- by way of two demand drafts vide bearing Nos.624738 dated 27.07.2015 and 093365 dated 01.08.2015, hence to permit for compounding the offence.
3. Having heard the parties, permission is thereby accorded as the parties stated that they have amicably settled the matter to purchase peace. Accordingly, the offence is compounded in terms of their compromise at the instance of the de facto complainant since present with the petitioners.
4. Accordingly, Crl.P.M.P.No.7966 of 2015 is allowed.
Consequently, the criminal petition is allowed and all the proceedings relating to C.C.No.868 of 2010 on the file of the Chief Metropolitan Magistrate, Vijayawada, are quashed against the petitioner. The bail bonds of the petitioners/A.1 to A.5, if any, shall stand cancelled.
5. Miscellaneous petitions pending, if any, shall stand closed.
