THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10096 of 2015 ORDER:
This Criminal Petition is filed by the petitioner - A2, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.831 of 2015 on the file of KPHB Colony Police Station, Cyberabad, registered for the offence punishable under Section 304-B IPC.
Heard and perused the material available on record. Petitioner is the mother-in-law of the deceased. The allegation against the petitioner is that she instigated A1 to harass his wife for bringing additional dowry and also to beat her, due to the said harassment, the deceased committed suicide. Learned counsel for the petitioner submitted that the marriage between the son of the petitioner and the deceased was performed in the year 2014 and the deceased herself left the company of her husband in the year 2015 and stayed along with her parents and committed suicide in her parents' house on 08.09.2015. A reading of the complaint discloses that most of the allegations are made against A1 only and as far as this petitioner is concerned, the allegations are not so serious.
Hence, this Court is inclined to grant anticipatory bail to the petitioner. In the circumstances, the petitioner - A2 is directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, she shall be released on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the petitioner is directed to appear before the Station House Officer concerned, as and when required.
Accordingly, the Criminal Petition is allowed. ______________ RAJA ELANGO, J
