This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioner who is arrayed as Accused No.1 in C.C.No.18529 of 2019 pending on the file of XIII Additional Chief Metropolitan Magistrate, Manoranjani Complex, Nampally, Hyderabad which arose out of Crime No.368 of 2019 of WPS, CCS, Hyderabad registered for the offences punishable under Section 498-A of Indian Penal Code and Sections 4 and 6 of Dowry Prohibition Act.

Heard the learned counsel for the petitioner-Accused No.1 and learned Additional Public Prosecutor for the respondent-State. Perused the record.

Learned counsel for the petitioner submits that the petitioner who is a resident of UK would surrender before the Court of XIII Additional Chief Metropolitan Magistrate, Manoranjani Complex, Nampally, Hyderabad on 21.11.2022.

Keeping in view the offences alleged are under Section 498-A of IPC and Sections 4 and 6 of DP Act and the circumstances in the present case, the petitioner-Accused No.1 is directed to surrender before the XIII Additional Chief Metropolitan Magistrate, Manoranjani Complex, Nampally, Hyderabad on 21.11.2022 by filing an application under Section 70(2) of Cr.P.C. and upon such surrender the learned Magistrate shall dispose off the said application on certain conditions to be imposed, while recalling the warrants, on failure to surrender before the concerned Court, this order stands dismissed.

Further, the petitioner is directed to surrender his passport before the XIII Additional Chief Metropolitan Magistrate, Manoranjani Complex, Nampally, Hyderabad. In the event of any exigency that arises for travel, the petitioner shall move the concerned Court seeking permission to travel. 6.
