THE HON'BLE SRI JUSTICE P.NAVEEN RAO CIVIL REVISION PETITION No.230 of 2016 ORDER :

The petitioners filed I.A.No.06 of 2016 in O.S.No.01 of 2016 on the file of Junior Civil Judge, Uravakonda, praying to permit them to take photographs and videograph regarding plaint schedule mentioned property in which they are in possession and enjoyment, as the respondent is trying to damage the boundaries and cut the sweet lime garden/Cheeni trees in their land highhandedly by using force and with the JCB and Proclainers.

2. The said I.A.No.06 of 2016 was filed along with I.A.No.07 of 2016 aggrieved by the order of injunction granted by the trial Court in I.A.No.02 of 2016.

When I.A.No.06 of 2016 was taken up on 07.01.2016, the trial Court, while ordering notice to the respondent, adjourned the matter to 04.02.2016 to be called along with I.A.No.07 of 2016 which is also posted to the same date. At this stage, this Civil Revision Petition is filed.

3. Since the subject matter is now pending consideration before the trial Court, this Court cannot express any opinion at this stage. The petitioners are not remediless and they can work out their remedies as available in law as and when orders are passed in I.A.No.06 of 2016 or if the matter is dragged on without disposing of the I.A.

4. Having regard to the facts of the case, granting liberty to the petitioners to seek early disposal of I.A.No.06 of 2016 in O.S.No.01 of 2016 pending before the trial Court, this Civil Revision Petition is dismissed. There shall be no order as to costs.

5. Miscellaneous petitions, if any, pending in this civil revision petition shall stand dismissed.
