Heard learned Senior counsel Sri Gangaiah Naidu for the petitioner and learned Government Pleader for Higher Education for respondents 1 and 2.

The petitioner's grievance in the writ petition is two fold. One is alteration of his date of birth in the service record and the second limb is continuation in service up to the age of 60 years. The employer is a private Engineering College. On the issue regarding alteration of his date of birth in the service record, writ remedy is not available as no public law element is involved nor any violation of statutory mandate by the employer, but it purely concerns terms of contract of employment.

With reference to the second limb of prayer, liberty is granted to petitioner to make an application before respondents 4 and 5, within two (2) days from today, to extend the age of superannuation to 60 years. If such an application is made within two days, the same shall be considered, as early as possible at any rate before 31.08.2018, the date fixed for retirement of the petitioner and decision be communicated to him. 4.
