HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.10375 of 2005 ORDER:

This Writ Petition is filed by the petitioner to direct the 7th respondent to register the appeal filed by him. 2.

It is purely a dispute between the petitioner and the unofficial respondents with regard to the subject land and this Court cannot adjudicate the issue. In sofar as the grievance of the petitioner that the appeal filed by the petitioner is not taken on record by the 7th respondent is concerned, learned Government Pleader submits that 7th respondent filed counter-affidavit and at para No.5 it is categorically stated that that the petitioner has not filed any appeal before the competent authority ie., the 6th respondent under Section 5 (5) of ROR Act, 1971.

In view of the same, this Writ Petition is dismissed. However, the petitioner is at liberty to approach the appropriate authority, under law, as and when fresh cause of action arises. As a sequel, Miscellaneous Petition/s, if any, pending, shall stand closed.
