ORDER

This petition under Section 482 of Cr.P.C., is filed to quash the order dated 05.06.2018 passed in Crl.M.P.No.1199 of 2017 in M.C.No.9 of 2008 by the Judicial First Class Magistrate, Kotturu, Srikakulam District.

The petitioner is the husband, against whom respondents 1 and 2 obtained an order under Section 125 of Cr.P.C., for payment of maintenance. The petitioner admittedly failed to pay the maintenance comes to Rs.10,800/- to respondents 1 and 2. Therefore, the Court below issued NBW against him. 3.

During hearing, the counsel for petitioner Sri K. Chaithanya, representing Sri S.R.Sanku, counsel for petitioner, sought four weeks time to pay the arrears of maintenance by petitioner and requested to suspend the execution of NBW issued against the petitioner on 05.06.2018.

In view of the request made by the counsel for petitioner, four weeks time is granted to petitioner for payment of arrears of maintenance commencing from today, till then, the NBW issued against him is kept under suspension, and in case the petitioner failed to pay the arrears of maintenance including the maintenance for the subsequent period from today, the Court below is directed to

MSM, J Crl.P.No.8793 of 2018 proceed further by entrusting the NBW to the concerned police for execution.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
