The plaintiff is revision petitioner. He filed interlocutory application

under Order 28 Rule 5 read with Section 151 of CPC seeking attachment of three properties mentioned in the schedule. The Court below considered the issue and accepted the claim of the petitioner insofar as Item No.1 property in the schedule is concerned.

It is the specific assertion of the respondent that Item No.1 property is worth approximately 60 lakhs and suit is decreed for only Rs.9,79,100/-. There is no denial to the claim of the respondent about the value of the property and no other material is filed to show that the interest of the petitioner was not safeguarded on account of denial of the claim of the petitioner in I A No.141 of 2012 for attachment of other two properties also. More over, according to the averments of the respondent, the other two properties stand in the name of family members and do not belong to him. This contention is not denied.

In the circumstances, I do not see any error in the order under revision warranting interference. Accordingly, the revision is dismissed. No costs. ______________ P NAVEEN RAO,J DATE:10.6.2016 TVK
